1. GENERAL PROVISIONS

1.1. These Terms of Service (“Terms”) govern the use of the online store operated by Caliathletics sp. z o.o. (“Seller”, “we”, “us”, “our”) at https://shop.caliathletics.com/ (the “Store” or the “Website”).
1.2. By placing an order through the Store, you (“Customer”, “Buyer”, “you”) agree to be bound by these Terms.

1.4. A “Consumer” is any natural person acting outside their trade, business, or profession.
1.5. These Terms apply to both Consumers and Businesses unless explicitly stated otherwise.

2. ORDERS AND ACCOUNT REGISTRATION

2.1. Orders can be placed 24/7 via our Store, either as a registered user or as a guest.
2.2. Ordering process:

Add products to your shopping cart.

Proceed to checkout and provide required personal, shipping, and payment details.

Confirm your order and finalize payment.
2.3. You will receive an order confirmation via email.
2.4. We may refuse or cancel orders in cases of suspected fraud, incorrect product information, or other reasons beyond our control.

3. PRICES AND PAYMENT

3.1. Prices are displayed in EUR/USD/PLN and include VAT (if applicable).
3.2. Accepted payment methods: bank transfer, credit/debit cards, online payment platforms (e.g., PayPal).
3.3. Price changes will not affect confirmed orders.

4. SHIPPING AND DELIVERY

4.1. Orders are processed on business days (Monday–Friday) excluding Polish public holidays.
4.2. Delivery times vary by location, shipping method, and product availability, including PREORDER products.
4.3. Shipping costs are borne by the Buyer unless otherwise stated.
4.4. If an order is undeliverable due to incorrect or incomplete address provided by the Buyer, or if the Buyer fails to collect the parcel, resulting in its return to the Seller, the Buyer will be charged for both the original and return shipping costs.

4A. PREORDERS

4A.1. Some products offered in the Store may be sold as PREORDER. Such products are clearly marked as “PREORDER” on the product page before the order is placed.

4A.2. Products sold as PREORDER are not immediately available for shipment. The estimated or maximum delivery timeframe is indicated individually on the product page.

4A.3. The delivery timeframe provided for PREORDER products is a maximum timeframe. Orders may be shipped earlier if the products arrive at our warehouse sooner.

4A.4. By placing an order for a PREORDER product, the Buyer acknowledges and accepts the extended delivery timeframe.

4A.5. The Buyer has the right to cancel a PREORDER order at any time before shipment. In such case, the Seller will refund all payments made by the Buyer without undue delay, and no later than within 14 days from the cancellation request.

5. RIGHT OF WITHDRAWAL (RETURNS)

5.1. Consumers have the right to withdraw from the contract within 14 days of receiving the goods.
5.2. To exercise the right of withdrawal, send a clear statement to customerservice@caliathletics.com within the 14-day period.
5.3. Returned goods must be sent within 14 days of notifying us.
5.4. Return shipping costs are covered by the Buyer.
5.5. We refund the product price within 14 days of receiving the returned goods (or proof of shipment), using the same payment method, unless agreed otherwise.
5.6. The Buyer is responsible for any decrease in the value of goods resulting from handling beyond what is necessary to establish their nature and functioning.

6. INTERNATIONAL ORDERS, CUSTOMS DUTIES & REFUSAL OF DELIVERY

6.1. Since 21.11.2025 we implemented a feature of automatically collecting duty, and tax for the customer - your package will arrive at your place, no additional costs required during customs clearance. If your order was made prior to that (21.11.2025 6pm. CET) we are not responsible for these charges if they are applied and are your responsibility as the customer.

6.2 Only for orders made prior (21.11.2025 6pm. CET) - for deliveries outside the EU, the Buyer is responsible for any customs duties, import taxes, or handling fees charged by authorities in the destination country.

6.2. Only for orders made prior (21.11.2025 6pm. CET) - buyers are encouraged to check applicable customs duties and taxes before placing an order, via the official website of the customs authority in their country, local postal services, or the selected courier.

6.3. If the Buyer refuses to accept delivery or fails to complete customs procedures, resulting in the return of the parcel, the Seller may deduct both the outbound and return shipping costs (and any other fees) from the refund.

7. COMPLAINTS, DAMAGED PARCELS & WARRANTY

7.1. All goods should be free from defects. We are liable for defects under applicable consumer law, including the Polish Civil Code if relevant.
7.2. Damaged parcel on delivery – If the package arrives damaged, the Buyer must:

  • Request a damage protocol from the courier at the time of delivery.
  • Take clear photos of the packaging and the damaged item.
  • Send the documentation to customerservice@caliathletics.com without undue delay.

7.3. Defects discovered after delivery – If a product becomes defective within the legal warranty period (2 years for Consumers, with reversed burden of proof in the first year), the Buyer should contact us with:

  • Description of the defect
  • Proof of purchase
  • Photos or videos showing the defect

7.4. If the complaint is justified, the Seller will decide on the appropriate remedy, taking into account the nature of the defect and legal requirements. Possible remedies include:

  • Repair of the product
  • Replacement with a new product
  • Price reduction or full refund (in case of significant defects)

7.5. Complaints may be rejected if the defect is caused by improper use or normal wear and tear.

8. PERSONAL DATA PROTECTION

8.1. The administrator of personal data is Caliathletics sp. z o.o.
8.2. Personal data is processed for order fulfilment, communication, handling returns, and marketing (with consent).

9. GOVERNING LAW & DISPUTE RESOLUTION

9.1. These Terms are governed by Polish law, without prejudice to mandatory consumer protections in your country.
9.2. Disputes will be handled by competent Polish courts, unless consumer law requires otherwise.

10. FINAL PROVISIONS

10.1. We may amend these Terms due to changes in law or business operations. Updated Terms will apply to future orders.
10.2. If any provision is deemed invalid, the remaining provisions remain in effect.
